The State - the concept and elements of the State
The concept and elements of the State
According to Prof. According to J. Brzozowski, a state is an organized territorial unit that is a subject of international law. A less formal definition describes the State as a political social organization endowed with sovereign power. Based on this definition, in order for a given entity to be considered a State, it must meet the following conditions:
- he must have a certain territory.
- this territory should be inhabited by people (population) with a common history, culture, and so on. (the sociological element of the concept of the state)
- the state should have the highest authority and, therefore, be a sovereign entity
According to her, the marine areas were divided into:
- internal sea waters, sea channels, straits, the continental shelf and the waters of the archipelago (full, sovereign powers with appropriate modifications) at a distance of up to 10 nautical miles from the coast, including bays, etc. - called historical waters,
- territorial seas (full capacity, but freedom of movement for other vessels) up to 12 nautical miles,
- adjacent marine area (state control functions) up to 24 nautical miles,
- exclusive fishing zone (exclusive right to fish) up to 200 nautical miles (Poland has only 12 miles due to the intersection of our country's zone with the Swedish zone),
- economic zone (exploration, development and management of natural resources) up to 200 miles,
- the open sea (a zone not under the jurisdiction of any State).
The territory of the state is considered to be a three-dimensional surface on which the power of the state extends. Although some scholars doubt the need for a territory for a State, this is a prerequisite for recognizing its identity. Therefore, we will not call the Jews who lived in the Diaspora before the middle of the twentieth century a state, but at best a nation. Thus, the territory includes: the land with colonies (including islands and central inland waters), the marine zone, the interior of the earth (theoretically to the core of the earth, in practice as deep as you can reach), the airspace (the upper limit is not defined, but in practice up to 400 km, because the lowest satellites fly under this ceiling), areas of diplomatic missions, areas of the sea and airplanes (obviously, their volume is not counted in the statistical region of the country).
The area of a land plot is most often determined by borders. Their course can be determined artificially or naturally. On land, most often using poles, nets, etc. If countries are separated by a river (a natural river), the border runs along the deepest riverbed (talweg) or in the middle of the riverbed (median). If there is a bridge on the demarcation line, it is divided in half, and in the case of a lake (for example, the Great Lakes in South America), states must conclude a separate international agreement. The issue of marine areas in the context of territoriality is regulated by international maritime law (for example, the 1982 Convention on the Law of the Sea).
